TERMS AND CONDITIONS

DEFINITIONS

[1] The Company means Kevin Turner trading as freedom2ride.cc or GoMTBKids.

[2] The Customer means any person, firm, company or other legal entity which places an order or buys any products, services or courses from the Company and includes the employees, servants, agents or sub-contractors of any such person, firm company or other legal entity.

[3] Service means any course or activity or facility offered by the Company.

[4] Contract means a contract between the Company and the Customer for the provision of products or services.

[5] Statutory Interest means statutory interest for the Late Payment of Commercial Debts (Interest) Act 1998.

[6] Terms and Conditions means these terms and conditions of provision.

APPLICABILITY OF TERMS AND CONDITIONS

[7] These terms and conditions shall be incorporated into the contract and shall apply in place of and prevail over any terms and conditions contained or referred to in any communication from the Customer or implied by custom or practice. Other terms and conditions are expressly rejected by the Company.

BOOKING CONDITIONS

[8] The contract shall be formed when the Company acknowledges acceptance of the Customer’s booking form and required payment.

[9] Participation in adventurous activities entails some risk of injury. All staff employed by the Company are trained and appropriately qualified to run activity sessions and will at all times proceed in a manner to limit the risk of injury. However, customers need to accept that accidents and injuries can happen.

[10] A detailed kit list will be sent to you upon receipt of your deposit/full payment, and meeting instructions and final trip arrangements will be sent to you two weeks prior to your trip start date.

It is essential that you provide all equipment detailed. The client is responsible for providing correct contact information including email and mobile phone number. Any failure in services resulting from us having incorrect contact information will be deemed to be the fault of the client and no compensation will be available. All required participant, medical and contact details must be provided through the online booking platform, or separately where further information is requested by the Company.

BICYCLE CONDITION, SUITABILITY AND PARENT / CARER RESPONSIBILITIES

[12] All bicycles and equipment used during activities, coaching sessions or events delivered by the Company must be safe, appropriately maintained and suitable for the prescribed activity, terrain and rider.

[13] In accordance with guidance issued by British Cycling, the Company may undertake a visual pre-session safety inspection of bicycles, helmets and equipment prior to participation.

[14] Parents and carers acknowledge and agree that responsibility for the ongoing condition, maintenance and suitability of a child’s bicycle and equipment remains solely with the parent, carer or owner of the equipment.

[15] Parents and carers are responsible for ensuring that:

  • the bicycle is mechanically safe and in good working order;

  • the bicycle is suitable for the child’s size, age, strength, experience and intended activity;

  • the bicycle is appropriate for the terrain and environmental conditions;

  • all components, including brakes, tyres, steering, drivetrain and wheels, are properly maintained and functioning correctly;

  • any damage, defects, faults or previous crash damage are disclosed to the Company before participation.

[16] Parents and carers should ensure bicycles are regularly inspected, serviced and maintained by a reputable professional cycle mechanic, independent bicycle dealer (IBD) or recognised cycle servicing centre.

[17] Where a parent or carer is uncertain about the safety or suitability of any bicycle or equipment, they must obtain appropriate professional advice before the child participates in any activity.

[18] As a minimum requirement, all bicycles used during activities must:

  • have two properly functioning brakes;

  • have secure wheels, handlebars, pedals and components;

  • have tyres suitable for the intended riding surface and conditions;

  • be free from material damage, structural defects or excessive wear;

  • be appropriately sized for the rider.

[19] Parents and carers are additionally responsible for ensuring that:

  • helmets are correctly fitted, undamaged and suitable for cycling use;

  • participants wear suitable clothing and footwear for the activity and weather conditions;

  • any additional protective equipment used is safe and fit for purpose.

[20] Any inspection carried out by the Company, its coaches, staff or volunteers is limited to a general visual and functional observation only and shall not constitute:

  • a professional mechanical inspection;

  • certification of safety or roadworthiness;

  • acceptance of responsibility for the bicycle or equipment;

  • any warranty as to the condition or suitability of the bicycle or equipment.

[21] The Company reserves the absolute right to refuse participation where, in the reasonable opinion of the Company, coach or authorised representative:

  • a bicycle or helmet is unsafe;

  • equipment is unsuitable;

  • participation may place the rider or others at risk of harm.

[22] No refund or compensation shall be payable where participation is refused due to unsafe, unsuitable or defective equipment.

[23] If during the period of the coached or guided activity the bike you have provided has a mechanical failure or is damaged as a result of a crash, and is rendered un-rideable the Company cannot be held liable. We will do our utmost to provide trailside assistance, be that by the accompanying guide or shadow support vehicle on supported group trips. If no easy fix can be made, the Company cannot be liable and no refund will be provided if you have to leave the coached or guided activity. The Company will not be liable for any onward travel costs from that stage. Where possible we will render assistance. Our guided trips are self-sufficient, and we use a Remote Emergency Point of Contact (EPC) which generally will only be used for medical emergencies.

[24] Please note that whilst all reasonable efforts will be made by us to ensure the safekeeping of your bike, we cannot be held responsible for any loss or damage to your bike as a result of your participation in the coached or guided activity or otherwise. We always recommend guest bikes are fully insured.

[23] All bookings are on the basis that the Customer will, at all times, observe the safety regulations set by the Company.

[24] The contract is subject to availability of a course place/date and the acceptance by the Customer of these terms and conditions.

[25] Neither the Company website nor literature constitutes an offer and the Company may correct any errors or omissions to its published prices at any time prior to the confirmation of the contract in accordance with this condition.

[26] All information is produced in good faith that it is accurate at the time of publishing.

ALL FEES

[27] If payment is not made in accordance with these conditions, the Company reserves the right to charge statutory interest on the overdue/outstanding balance for the period from the date on which payment became due until the date on which payment is made including any period after the date of judgement or decree against the Customer.

FEES – SCHEDULED AND PRIVATE COURSES

[28] For multi-day trips or courses booked in advance, 25% of the course fee is required to reserve a place on a course. For short day rides or activities/courses, 100% of the course fee is required upon booking.

[29] The whole course fee is required to reserve a place for any booking made within 6 weeks of the commencement of the course.

[30] The balance of the fee is payable 6 weeks prior to the commencement of the course. In the event that the balance is not paid the Company will have the discretion to treat the booking as cancelled by the Customer. The time for payment shall be the essence of the contract.

AMENDMENTS BY THE CUSTOMER

[31] Substitution of the original Customer for another can be made provided the substituting Customer satisfies the requirement of the course. All substitutions must be made with the consent of the Company with both the substituted and substituting Customer being jointly and severally liable for the total course fee as well as an administrative cost of £5.00 per course/substitution.

[32] A Customer may apply, in writing, to change course or course dates as long as the original booking is more than 6 weeks from the date of the request. The new course must be one that appears on our website. An administrative charge of £5.00 is payable at the time of change. Any requests to change course or course dates within the 6-week period will be dealt with under the terms and conditions relating to cancellation by the Customer.

CANCELLATIONS

[33] Deposits (where applicable) are non-refundable. You are advised to take out your own travel insurance when you book. This may allow you to recover prior payments (usually less an excess) if you have to cancel and the circumstances of your cancellation are covered by the insurance contract.

[34] Course sizes described on the website are target sizes and may be increased or decreased at the discretion of the Company. The Company gives no undertaking as to the minimum or maximum size of a course but do undertake to ensure that Leaders, Guides, Instructors and support staff are supplied in appropriate numbers to ensure the principle objectives of the course can be achieved.

[35] The Company reserves the right to cancel any course which does not have sufficient people taking part to make it financially viable, or to cancel your participation alone if not to do so would result in a financial penalty. By the same token, the Company will endeavour to ensure that a course runs if at all possible. If your booking is likely to be cancelled under such circumstances, the Company undertakes to inform you as soon as possible; this may occur after the balance due date but will not occur less than 6 weeks before the course start date.

[36] Anyone booked onto a course which is cancelled by the Company will be entitled to a full refund or entitled to transfer to another course and no transfer fee will be payable. Should you transfer to another course any difference in price will be invoiced or credited accordingly.

[37] Similar cancellation terms are adopted throughout the travel industry and cover the costs of advance payments made by the Company, and the effect of your booking having prevented others from taking your place. Cancellation charges may be covered, in part, by your travel insurance provided the reason for cancellation falls within the terms of the policy.

Weather Related Cancellations

The Company will always conduct a risk assessment based on weather forecasts provided by the Met Office. In general, mountain biking activities will often proceed rain or shine unless there are specific high-risk weather warnings or conditions in place.

The Company will work with relevant stakeholders and land managers to determine whether forests, parks or trail venues remain open based on their own inspection and risk assessment processes.

The Company will provide guidance on the clothing and equipment required to safely take part in the activity. Participants remain responsible for arriving appropriately equipped for the prevailing conditions.

CANCELLATION BY THE CUSTOMER (SCHEDULED/PRIVATE COURSES)

[38] All cancellations must be in writing and sent either by post or email. The Company will acknowledge a cancellation within 5 days of receiving it. Until the Customer has received confirmation the original booking remains valid.

[39] The Customer will be charged on the following basis:

  • 25% of the total course fee where cancellation takes place less than 6 weeks but more than 4 weeks before the commencement of the course; or

  • 50% of the total course fee where cancellation takes place less than 4 weeks but more than 2 weeks before the commencement of the course; or

  • 100% of the total course fee where cancellation takes place within the period of 2 weeks before the commencement date of the course; or

  • 100% of the total course fee where cancellation takes place on or after the commencement date of the course.

CANCELLATION BY THE COMPANY

[40] Whilst every attempt is made to ensure that courses/activities actually run, the Company will notify the Customer of cancellation as soon as practicable where it believes on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the course/activity.

[41] The Company shall notify the Customer of cancellation not less than five days prior to the commencement of the course where numbers as a result of either Customer(s) cancellation or booked numbers have failed to reach a workable minimum.

[42] Cancellation by the Company does not affect a Customer’s right to a refund of travel costs that he/she may have incurred prior to the cancellation and since lost except in the circumstances set out in the clauses above.

[43] In the event of cancellation customers will be offered the choice of the following options:

  • Full refund of the fee paid; or

  • Another booking on a different date.

HEALTH & FITNESS / MEDICAL INCIDENTS

[44] Customers participating in courses/activities must expect to be involved in adventurous and sometimes strenuous activities. Although prior experience and/or training is not necessary on all the courses/activities customers are expected to be of good general health. The medical section on the booking form must be completed as part of the booking process. All prior injuries and/or serious illnesses must be declared. Any injury or illness occurring between the time of the declaration and the commencement of the course must be reported. The Customer must satisfy him/herself that taking part in the course is within his/her own capabilities. The Company reserves the right to refuse a booking on medical grounds if it is considered to be detrimental to the safety and smooth running of the course.

Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details. You must be adequately fit to cover the distances and undertake the program set out in your itinerary. If it is felt that any client is not sufficiently fit, healthy, properly equipped or able to complete the coached or guided activity without affecting its safety, comfort or happy progress, the coached or guided activity leader at any stage has the right to remove you from the coached or guided activity. The Company will not be liable for any onward travel costs and no refund will be provided.

If during the period of the coached or guided activity you require medical assistance, beyond first aid as a result of a crash or any other medical incident, the Company cannot be liable and no refund will be provided if you have to leave the coached or guided activity. The Company will not be liable for any onward travel costs from that stage, or recovery/transfer of your bike and personal possessions. Where possible we will render assistance and first aid as your health and wellbeing, and that of the wider group is foremost. Our guided trips are self-sufficient and no vehicle or shadow assistance is provided; we use a Remote Emergency Point of Contact (EPC) which generally will only be used for medical emergencies for assistance and contacting next of kin. We recommend that you take out adequate travel/medical insurance to cover any costs.

DIETARY REQUIREMENTS

[45] Any special dietary requirements must be made at the time of booking. The Company cannot accept responsibility for not being able to deliver special dietary needs at short notice.

SAFETY REGULATIONS

[46] Outdoor adventurous activities take place in varied natural environments where there are natural hazards and risks to manage. Customers participating in courses are expected to comply with all safety guidance and instructions given by the Company and its staff.

Risk Assessments have been completed to comply with the requirements of the Management of Health & Safety at Work Regulations 1999, notably to consider the potential risks to the health and/or safety of anyone who may be adversely affected, including employees, participants, and members of the public. The assessment has been completed using a semi-quantitative risk assessment method.

“Parents, Supervisors, Teachers and all participants should be aware that adventurous activity can result in accidents, and on rare occasions, some of these can be serious.”

The purpose of this risk assessment process is to identify potential risks and minimise them by implementing appropriate planning and control measures.

Mountain biking is an adventurous activity. Guided rides, skills sessions, and coaching programmes mean participants will undertake activities under supervision that they may not have previously experienced individually. The intention is to develop competence, confidence, and technical ability so individuals can enjoy mountain biking safely and sustainably.

Whilst coaches and leaders must remain vigilant regarding safety and continuously evaluate risk, it must be recognised that it is neither possible nor desirable to eliminate all risk. The key factor in managing risk is the experience, judgement, and decision-making of the coach or leader.

All coaching delivery aligns with good practice expectations of British Cycling.

UNRULY BEHAVIOUR

[47] Behaviour that disrupts the smooth running of an event may result in the disruptive Customer(s) being excluded. Any damage caused to property or equipment as a result of unruly behaviour will be charged for.

For all children’s coaching sessions, activities and trips, the Company operates in line with NSPCC CPSU safeguarding guidance and codes of conduct.

PLAY BY THE RULES

  1. Be yourself and welcome others.

  2. Be respectful to others and take care of equipment and the space.

  3. Try your best and have fun.

  4. Listen to your coach or trainer.

  5. Remind a parent or carer to bring the right kit, food and drinks with you.

  6. Please do not wander off or leave without telling a member of staff.

  7. Speak out if you feel worried – reach out to someone you trust or contact Childline. This could be a parent or family member, coach, the club welfare officer or another trusted adult.

Further safeguarding information and guidance is available from the NSPCC Child Protection in Sport Unit (CPSU).

PERSONAL PROPERTY

[48] Property belonging to the Customer is at all times the responsibility of the Customer unless any loss or damage is due to negligence by the Company or its representatives.

COMPLAINTS

[49] If the Customer encounters any problem or difficulty the Company will try and resolve them as soon as is possible. In the first instance report anything to the guide. Further complaint can be made in writing or by email. Your concerns will be dealt with within 28 days of writing.

FORCE MAJEURE

[50] The Company shall have no liability whatsoever in respect of any delay or failure in delivery of any of the courses or of any of the Company’s other obligations due directly or indirectly to any cause whatsoever outside the reasonable control of the Company including but not limited to act of God, war, invasion, rebellion, riot, civil commotion, disorder, malicious damage, fire, flood, quarantine restriction, strikes or other industrial disputes, unusually severe weather or energy supplies.

LIABILITY

[51] The Company will not be liable where any failure in the performance of the Contract is due to: you; or a third party unconnected with the provision of the course and where the failure is unforeseeable or unavoidable; an event listed in clause 39 or any other unusual and unforeseeable circumstances beyond the Company’s control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which the Company or its suppliers, even with all due care, could not foresee or forestall.

[52] The Company shall not be liable for any illness, injury or loss of life sustained on any course, except where such illness, injury or loss of life is caused by the negligence of the Company or its employees, nor will the Company be liable for any uninsured loss of personal property.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot lawfully be excluded under English law.

For all courses, you are advised to have insurance that covers you for all activities.

INTELLECTUAL PROPERTY

[53] Copyright and all other intellectual property rights in the products and services shown in the Company’s price lists, website and any literature shall remain at all times the property of the Company. The Customer shall acquire no rights in the products and services except as expressly provided for in these terms and conditions.

PHOTOGRAPHY AND FILMING POLICY

[54] This policy applies to:

• All children and young people involved with freedom2ride.cc and GoMTBKids – any person under the age of 18.
• All parents and carers with responsibility for a child involved with freedom2ride.cc and GoMTBKids.
• All staff and volunteers involved with freedom2ride.cc and GoMTBKids.

Our Statement

Our commitment to keeping children and young people safe whilst in our care is our highest priority. Photos and videos celebrate achievements and are a great way to promote our organisation but must be created and used responsibly and with respect for the privacy and safety of our participants.

Our Policy

This policy outlines how freedom2ride.cc and GoMTBKids will put guidance and safeguards in place for the appropriate use of photography and filming of participants, and our expectations for all participants, coaches, staff, volunteers, parents, carers and spectators.

What We Will Do

As part of our photography and filming policy we will take, store and process images and videos in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We will also:

  • promote and prioritise the safe use and storage of images and videos

  • value, listen to and respect all children, parents, carers, staff, volunteers and spectators

  • ensure robust photography and filming procedures are in place

  • adopt safeguarding best practice through our policies, procedures and code of conduct for staff and volunteers

  • gain written consent from children and parents or carers before taking or sharing any photos or videos – participants, parents and carers can withdraw their consent at any time

  • make sure images and videos are used in accordance with the consent provided

  • outline the use and storage of any images and videos taken when consent is requested

  • put measures in place if a child, parent or carer does not wish to give consent to be photographed or filmed

  • use images and videos for the purpose of training, promoting and celebrating our organisation

  • store images securely and limit access to authorised individuals only

  • allow authorised staff who have received appropriate training to take photos and videos

  • monitor and manage the use of images to prevent misuse

  • encourage participants, parents, carers and spectators to report any concerns about inappropriate use of images or videos to a member of staff or safeguarding lead, in line with our safeguarding procedures

  • act immediately to address any reported concerns or worries

  • provide training to staff and volunteers on the policy and its importance

  • only use external agencies who abide by our photography and filming policies

  • adhere to our online safety policy when sharing any images or videos online

What We Will Not Do

As part of our photography and filming policy we will not:

  • take, use, or share photos or videos that could be considered inappropriate or abusive

  • include full names and addresses alongside images of children and young people

  • use images or videos that could make a child easily identifiable

Monitoring

This policy will be reviewed every three years, or sooner in the following circumstances:

  • changes in legislation or government guidance

  • updated guidance from safeguarding partnerships, British Cycling, funding bodies or sports councils

  • as a result of any other significant change, event or case review

MOBILE PHONE & SMART DEVICE POLICY

For Youth Mountain Bike Coaching, Guided Rides & Activities

This policy applies to all children and young people participating in activities delivered by freedom2ride.cc / GoMTBKids.

Purpose of This Policy

The aim of this policy is to:

  • Promote safety, attention and participation during coached and guided mountain bike activities.

  • Reduce distraction whilst riding and during coaching instruction.

  • Protect the privacy and safeguarding of all participants.

  • Encourage positive and respectful behaviour within the group environment.

Mountain biking is an adventurous activity requiring concentration, awareness and communication. Mobile phone use during activities can create unnecessary risks to riders and others.

Hands for Handlebars Principle

Participants are encouraged to keep their hands for handlebars during all coached or guided riding activities.

Children and young people may carry a mobile phone or smart device for emergency purposes, however the following rules apply at all times during sessions.

Participant Mobile Phone Rules

Phones Must Be Silent

All mobile phones, smart watches and similar devices must:

  • be placed on silent mode before the activity begins.

  • not cause disruption through calls, notifications, alarms or sounds.

Secure Storage

If a participant chooses to carry a phone or smart device, it must be:

  • stored securely in a zipped pocket, hydration pack or backpack.

  • kept safely protected from damage or loss.

  • not carried loosely in hands whilst riding.

The Company cannot accept responsibility for loss, theft or damage to personal devices.

No Use During Coaching Sessions

Mobile phones and smart devices must not be used during activities for:

  • messaging or social media.

  • internet browsing.

  • gaming.

  • watching videos or streaming.

  • recording video.

  • taking photographs.

  • audio recording.

  • accessing online platforms or apps unrelated to the activity.

Devices should only be accessed if specifically instructed by the coach or activity leader.

Photography & Video

Participants must not use personal devices to photograph or film:

  • other children or participants.

  • coaches, leaders or volunteers.

  • activity locations where others may reasonably expect privacy.

Any official photography or video used for coaching analysis, promotion or safeguarding purposes will only be undertaken by authorised staff and in accordance with parental consent and safeguarding procedures.

Parent & Carer Contact During Activities

To maintain safety and minimise distraction:

  • participants should not contact parents or carers during the activity unless instructed by the coach or leader.

  • parents and carers should avoid contacting children directly during sessions unless urgent.

If an incident, emergency, welfare concern or significant delay occurs, contact with parents or carers will be made by:

  • the coach,

  • ride leader,

  • activity guide, or

  • designated responsible adult.

Emergencies

In exceptional circumstances, a participant may be permitted to use their phone if authorised by the coach or ride leader.

DATA PROTECTION

[55] The personal information requested by the Company at the time of booking plus any subsequent information is held on paper and digitally. The information is required to assist the Company, employees, agents and sub-contractors to deliver the course and in maintaining the Company’s high standards of delivery.

By providing us with the information to process your booking you are agreeing that the information can be kept and accessed by authorised Company personnel.

Contact details will be used to advise you of future offers by post, email, SMS or phone ONLY if you have given us your permission to do so.

If you have not given us your permission to keep you up to date with what is happening at the Company we are unable to contact you for this purpose.

Participants have the right to request access to, correction or deletion of their personal data, subject to legal, insurance and safeguarding obligations.

Personal information will only be retained for as long as reasonably necessary for operational, legal, insurance and safeguarding purposes.

APPLICABLE LAW

[56] The Contract will be governed by the laws of England and any dispute will be dealt with under the jurisdiction of the courts of England.

[57] The statutory rights of the Customer are not affected by the above.

[58] When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them.

[59] The Company shall ensure that appropriate security measures are in place to protect your personal data (as defined in the Data Protection Act 1998 and to comply with the General Data Protection Regulation).
